TRAIN Law: What Changed and What Later Laws Replaced

The Tax Reform for Acceleration and Inclusion (TRAIN) Law reshaped the Philippine tax landscape. Here is a plain-language breakdown of its key provisions and how they affect individuals and businesses.

Direct answer

TRAIN is part of the history of the current tax system, not a complete current-tax guide. Apply its provisions together with later EOPT, CREATE, CREATE MORE and CMEPA amendments.

Individual income-tax reform came in stages

TRAIN introduced revised individual income-tax brackets beginning in 2018 and a further schedule from 2023. The 2023 schedule generally reduced rates in the affected taxable-income bands compared with the 2018–2022 schedule; the earlier rates were not lower. Taxable income up to ₱250,000 is generally within the zero-rate band, subject to taxpayer classification and the applicable provisions.

Business-tax options are conditional

TRAIN introduced an 8% option for qualifying self-employed individuals and professionals in lieu of graduated income tax and percentage tax, subject to election and eligibility. It did not make the option available to every business. A statement that every person below the VAT threshold pays 3% percentage tax overlooks elections, exclusions and other applicable rules.

Property and share transactions need their own classification

TRAIN introduced the 15% final tax on net capital gains from covered unlisted domestic shares; it was not simply an unchanged pre-TRAIN rule. Later CMEPA amendments mean current share transactions require a fresh analysis of the seller, issuer, listing and instrument.

Estate and donor’s tax reforms should not be summarized as an identical exemption for every taxpayer. Residency, citizenship, property location, deductions and the relevant taxable event matter. Do not attribute every longstanding exemption to TRAIN.

TRAIN also changed the VAT refund processing period to 90 days and provides the ordinary quarterly VAT return regime from January 2023. Subsequent rules must still be checked for the claim or filing at hand.

Use this as a history guide

For a present transaction, record its date, parties, taxpayer status, asset or service and governing amendments. Do not use an old TRAIN summary as a substitute for the current consolidated rule.
